Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") are a legal agreement between you and Unicorn Media Group LLC, a Florida limited liability company ("Unicorn", "we", "us" or "our"). They govern your use of the Unicorn mobile app for iOS and Android, our website at tradeunicorn.app and related services (together, the "Services").

By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Services.

2. Eligibility

You must be at least 13 years old to use Unicorn. If you are under 18, or under the age of majority where you live, you may use the Services only with the permission of a parent or guardian, who agrees to these Terms on your behalf and is responsible for your use, including any purchases. You may not use the Services if you are barred from doing so by law.

3. Simulated trading only. Not investment advice

• No real money. All balances, including the $1,000,000 starting capital in each event, are fantasy funds with no monetary value. No real securities, cryptocurrencies or other assets are bought, sold or held on your behalf.
• Not a broker or adviser. Unicorn is not a broker-dealer, exchange, investment adviser or financial institution, and is not registered as one with any regulator.
• No advice. Nothing in the Services, including AI-generated portfolios, risk labels, suggestions, trending lists, news, statistics or rankings, is financial, investment, tax or legal advice, or a recommendation to buy or sell any asset.
• Market data may differ from real markets. Prices, indices and news come from third-party providers and may be delayed, incomplete or inaccurate. Simulated results don't reflect real trading costs, liquidity or risk.
• Fantasy performance isn't predictive. Results in Unicorn do not indicate how you would perform with real money. If you invest real money, do your own research and consider speaking to a licensed professional.

4. Your account

• Give accurate information when you sign up and keep it up to date.
• Keep your password secure. You are responsible for everything that happens on your account. Tell us straight away if you think it has been compromised.
• One account per person. Don't create accounts for others, share accounts, or buy, sell or transfer accounts.
• Usernames must not impersonate anyone, infringe anyone's rights, or be offensive or misleading. We may change or remove a username that breaks these rules.

5. Events, scoring & leaderboards

We set the rules, schedules, scoring, ranking methods (including the Unicorn Trader Ranking) and rewards for each event, and we may change them. Some events are open to everyone, some are private, and some are limited to Platinum members.

We may correct errors in prices, trades, scores or results, including after an event ends. We may also void trades, adjust results, or disqualify players who break these Terms or exploit bugs or data errors. Our decisions on event results are final, except where the law says otherwise.

6. Coins, points & Trader Cards

Coins, points, Trader Cards, badges and other in-app items ("Virtual Items") are part of the game:

• Virtual Items have no monetary value. They can't be redeemed for cash, sold, traded or transferred outside the Services, and are not your property. We grant you a limited, revocable licence to use them within the Services.
• We may change, rebalance, limit or remove Virtual Items at any time.
• Virtual Items are forfeited when your account is closed or terminated.
• Playing Unicorn does not require a purchase. Unless we publish separate official rules for a specific promotion, no event awards real money or prizes with cash value.

7. Platinum membership

• What it is. Platinum is an optional paid membership that unlocks extra features, such as unlimited online event entries, Platinum events, Trader Cards, priority Trader Reports and advanced analytics. The exact features are described in the app and may change over time.
• Billing. Platinum is sold through the Apple App Store or Google Play and is billed to your app store account. Prices are shown in the app before you buy and may vary by country.
• Automatic renewal. Subscriptions renew automatically at the end of each monthly or annual period unless you cancel at least 24 hours before the period ends. Your account will be charged for renewal within 24 hours before the end of the current period.
• Cancelling. Manage or cancel your subscription in your Apple ID or Google Play account settings. Cancelling stops future renewals, and you keep Platinum benefits until the end of the period you've paid for. Deleting the app or your Unicorn account does not cancel your subscription.
• Refunds. Refunds are handled by Apple or Google under their refund policies. We can't issue refunds for purchases made through the app stores.
• Price changes. If we change the price, we'll give you advance notice as required by the app store and applicable law. The new price applies from your next renewal.

8. Acceptable use

You agree not to:

• cheat, collude with other players, use multiple accounts, or exploit bugs, glitches or data errors;
• use bots, scripts, scrapers or other automated means to access or play the Services;
• harass, threaten, abuse or impersonate others, or post hateful, obscene or illegal content;
• reverse engineer, decompile, interfere with or disrupt the Services or their security;
• use the Services to promote real-money investments or schemes, or to give investment advice to others for payment;
• sell, rent or commercially exploit the Services or any Virtual Items; or
• break any law or anyone else's rights.

9. Your content

You keep ownership of content you create in the Services, such as your username, profile details and the names and descriptions of events you create ("Your Content"). You give us a worldwide, royalty-free, non-exclusive licence to host, display and use Your Content to operate and promote the Services, including showing it to other players and on leaderboards. You are responsible for Your Content, and we may remove any of it that breaks these Terms.

10. Our intellectual property

The Services, including the Unicorn name, logo, design, software, text and graphics, are owned by Unicorn Media Group LLC or our licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Services for your own non-commercial entertainment. If you send us feedback or ideas, we may use them without any obligation to you.

11. Third-party data & services

The Services include market data, news and other content from third parties, and may link to third-party websites. We don't control and aren't responsible for third-party content, its accuracy or availability, or how third parties handle your information. Your use of third-party services is governed by their own terms.

12. App store terms

If you download Unicorn from the Apple App Store or Google Play, you also agree to that store's terms of service. If you use the iOS app, you and we acknowledge that:

• these Terms are between you and Unicorn only, not Apple, and Unicorn, not Apple, is responsible for the app and its content;
• your licence to use the app is limited to Apple-branded devices you own or control, as permitted by the App Store's Usage Rules;
• Apple has no obligation to provide maintenance or support for the app;
• if the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation;
• Unicorn, not Apple, is responsible for addressing any claims relating to the app, including product liability, legal or regulatory compliance and consumer protection claims;
• Unicorn, not Apple, is responsible for investigating and defending any claim that the app infringes a third party's intellectual property rights;
• you represent that you are not located in a country subject to a US government embargo and are not on any US government list of prohibited or restricted parties; and
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Suspension & termination

You can stop using the Services and delete your account at any time (see how to delete your account). We may suspend or close your account, remove Virtual Items or restrict access if you break these Terms, if we have to by law, or if we stop offering the Services. Where reasonable, we'll tell you first. Sections 3, 6, 9 to 11 and 14 to 17 survive termination.

14. Disclaimers

The Services are provided "as is" and "as available". To the fullest extent permitted by law, Unicorn disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Services, market data or results will be accurate, uninterrupted, error-free or secure.

15. Limitation of liability

To the fullest extent permitted by law, Unicorn and its members, managers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, Virtual Items or goodwill, arising out of or relating to the Services. This includes any losses from real-world investment decisions you make. Our total liability for any claim relating to the Services is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose or (b) US $50.

Some jurisdictions don't allow certain warranties or liabilities to be excluded, so some of the limits above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, or your statutory rights as a consumer.

16. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Unicorn and its members, managers, employees and agents from any claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms, Your Content or your misuse of the Services.

17. Governing law & disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law rules. Before filing a claim, you agree to contact us first and try to resolve the dispute informally for at least 30 days. Any dispute that isn't resolved informally will be brought exclusively in the state or federal courts located in Hillsborough County, Florida, and you and we consent to their jurisdiction.

If you are a consumer in the UK or EU, you keep the protection of any mandatory laws of your country of residence, and you may also bring proceedings in your local courts.

18. Changes to these terms

We may update these Terms from time to time. We will post the new version on this page and change the "last updated" date. If the changes are significant, we will also notify you in the app or by email. If you keep using the Services after the changes take effect, you accept the updated Terms.

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms and our Privacy Policy are the entire agreement between you and us about the Services.
